Photo: Ho\u00e0ng L\u1ed9c<\/em><\/p>\n<p>Land exists, but cannot be leased<br \/>\nAccording to the province&#8217;s report, the area of land that can actually be exploited in the quarries is much smaller than the permitted area due to legal and administrative barriers. Enterprises face difficulties in negotiating land use right transfers. After the transfer, they must change the land-use purpose before leasing it for mining operations.<\/p>\n<p>Even just transferring land use rights poses several challenges:<\/p>\n<p>Some plots cannot be transferred in their entirety.<\/p>\n<p>Some transferred areas lack land use certificates.<\/p>\n<p>In many cases, the landowners have passed away, moved, or have not completed inheritance procedures.<\/p>\n<p>In other cases, the transferred land\u2019s use duration has expired.<\/p>\n<p>These issues prevent companies from completing land lease procedures.<\/p>\n<p>A typical example is the 10 stone quarries in the Tam Ph\u01b0\u1edbc \u2013 Ph\u01b0\u1edbc T\u00e2n cluster, Bi\u00ean H\u00f2a City. While all have been granted mineral mining licenses and paid mining rights fees:<\/p>\n<p>9 out of 10 have only partially leased the licensed land.<\/p>\n<p>The remaining land has already been compensated for or transferred to the companies.<\/p>\n<p>The Provincial People\u2019s Committee has made efforts, including extending mining licenses, adjusting investment certificates, revising zoning plans, and approving land use plans. However, resolving these legal hurdles and completing land lease procedures still takes time.<\/p>\n<p>If the companies are forced to stop operations on unleased land, mining output would drop significantly. Photo: Ho\u00e0ng L\u1ed9c<\/em><\/p>\n<p><strong>Proposal: Allow operations while completing legal procedures until Dec 31, 2025<\/strong><\/p>\n<p>To address these issues, \u0110\u1ed3ng Nai Province has proposed that the Ministry of Agriculture and Environment allow companies to continue mining, processing, and operating on land already licensed and compensated for, but not yet fully leased, from now until December 31, 2025. The output from these areas would be exclusively used for key southern transportation projects.<\/p>\n<p>During this period, the Department of Agriculture and Environment will:<\/p>\n<p>Assist businesses in overcoming land-related legal obstacles.<\/p>\n<p>Ensure that they complete land lease procedures in accordance with regulations.<\/p>\n<p>Handle any administrative violations.<\/p>\n<p>Ensure payment of fees such as mining rights, taxes, land rental, and other legal obligations.<\/p>\n<p>Project investors and contractors have already estimated the required volume of materials for 2025. Based on these estimates, the Provincial People\u2019s Committee issued allocation plans per quarry and per project.
